Overnite Express reserves the right to unilaterally modify or amend any portion of Overnite Express’ Rate Table and Service Guide at any time without prior notice. The current version of the Terms and Conditions of Service and any modifications or amendments supersede all previous Overnite Express Rate and Service Guides. Any failure to enforce or apply a term or provision of the Overnite Express Rate Table and Service Guide shall not constitute a waiver of that term or provision by Overnite Express, and shall not diminish or impair Overnite’s right to enforce such term or provision in the future. "Overnite Express Services" includes EARLY Overnite®, MORNING Overnite®, NEXTDAY Overnite®, ONE Overnite®, NEXTDAY Remote®, 2nd Day Remote® and SATURDAY Overnite®. You should assume that everything you see or read on the Site is copyrighted, servicemarked and / or trademarked and may not be used except as provided in these Terms and Conditions without the prior written consent of Overnite Express. Overnite Express neither warrants nor represents that your use of materials displayed on the Site will not infringe rights of third parties not owned or affiliated with Overnite Express.
